It was okay when they first started with it because I'm sure that Gateway only released to the PDGA discs that they knew would pass the flexibility rating test. After they were approved in that blend, they were unlikely to be tested again. This is the same reason that the G9i blend from Gateway is also been deemed too stiff to be legal.

Now they were PDGA approved and are not having their approval revoked but they are not allowed to manufacture them anymore until they meet approval again (either by adding a softening agent to the plastic or an entirely new blend that meets current criteria).
